TERMS & CONDITIONS

Please review these Terms & Conditions carefully before placing a commission. By commissioning artwork from me, you confirm that you have read, understood, and accepted these Terms & Conditions. If you do not agree with any part of these Terms & Conditions, please refrain from placing a commission.

AGE REQUIREMENT

For safety and professional reasons, all Communication, Social Media interaction, and Commission - related contact are intended for individuals aged 18 and over only. I am not able to independently verify the age of every single person who contacts me - therefore, by submitting a commission request or engaging in any form of communication with me or my content, you confirm in good faith that you are at least 18 years of age.

COMMUNICATION

Clients who wish to request a commission or inquire about my services are welcome to contact me exclusively through VGen. All commission related inquiries, communication, payments, updates, and project details are handled through VGen to ensure a safe, organized, and properly documented process for both the client and myself. I do not accept commission requests or service inquiries through social media, email, or other communication channels.

CUSTOM COMMISSIONS REFUND POLICY

Refund eligibility for Custom Commissions depends on the current stage of production. If work has not yet started, you are eligible for a full refund (100%). Once the lineart has been completed, you are eligible for a partial refund (50%). Once coloring has begun, voluntary refunds are no longer available. Custom Commissions have a completion timeframe of approximately 4-6 months, depending on the commission type, selected add-ons, and provided delivery date. Regardless of the timeframe, if 2 months have passed since the order was placed and work has not started, a full refund will be issued rather than requesting an extension or keeping the commission in the queue. If I am unable to complete the commission within the agreed timeframe, I will not request an extension - the commission will be cancelled and a full refund will be issued.

SKEB COMMISSIONS REFUND POLICY

SKEB Commissions are non-refundable once accepted. However, there is one exception to this rule, specifically intended to prevent commissions from being kept indefinitely ("commission hostage"). SKEBs have a completion timeframe of approximately 3-4 months, depending on the type of SKEB and provided delivery date. If 2 months have passed since the order was placed and work has not started, the commission will be cancelled and a full refund will be issued. If I am unable to complete the SKEB within the agreed timeframe, I will not request an extension - the commission will be cancelled and a full refund will be issued.

PAYMENT INFORMATION

All payments are processed exclusively through VGen. Once your request has been accepted, you will receive a proposal containing the final price and will have 24 hours to complete the payment. If payment is not received within this timeframe, the commission request will be considered cancelled. Payment must be received in full before work begins. Instalment payments are available for commissions valued at 400 EUR or more. In such cases, work may begin after the first payment of at least 50% of the total price has been received, with the remaining balance due before the final files are delivered.

COMMISSION INFORMATION

Once payment has been received - either in full or as the first installment (minimum 50%) if a payment plan has been approved - the commission will be added to the queue. Work does not begin immediately upon payment; the commission becomes active once marked as WIP (Work in Progress). References and images are always appreciated and can help speed up the process. I primarily work with original characters and generally avoid commissions involving existing intellectual property. I do not create gore, hard kinks, sexual content involving minors, or heavy/complex armor designs.

Standard commissions go through several review stages, including a sketch, coloured lineart, and pre-final version before delivery. SKEB commissions are handled differently and follow a no-communication process, meaning no sketches, WIP updates, revisions, or approval stages are provided.

COMMISSION PROCESS

The commission process consists of two steps. First, I will provide you with sketches of your commission so you can review them and request any changes. Once the sketches are approved, we move on to the second step: applying lineart and colors. You will also receive a base-colored version for approval or possible color adjustments. Please note that during the coloring stage, no changes will be made to the lineart; only the colors can be adjusted.

COMMISSION CANCELLATION

I reserve the right to decline or cancel a commission at my discretion. In the event of cancellation initiated by me, a full refund will be provided. Commissions may be declined or cancelled due to, but not limited to: persistent lack of communication, repeated disregard of the provided timeline, harassment or inappropriate behavior, an inability to maintain a professional and respectful working relationship, or my inability to complete the commission within the agreed timeframe. In such cases, all work completed up to the point of cancellation will remain my intellectual property and may not be used, reproduced, or distributed without my explicit consent.

PRIORITY STATUS

Clients may also select a Priority option at the time of ordering, allowing their commission to enter the active queue immediately after the completion of the project currently in progress. Priority placement is available in three tiers: Standard Priority (+25%), Express Priority (+50%), and VIP Priority (+85%) of the total commission price. In addition to receiving priority placement within the queue, Priority commissions benefit from significantly reduced completion and delivery times whenever possible. Priority commissions are always processed before standard commissions while maintaining the order of other active priority projects.

CREATIVE PROCESS

Due to the nature of my creative process and the level of detail required for each commission, I actively work on up to three projects at a time, rotating between them to maintain consistent progress, quality, and focus. Your commission will enter the active WIP stage once a spot becomes available among these three projects. Before placing an order, clients should review the information provided on the VGen page regarding the overall delivery timeframe. By submitting a commission request, you acknowledge that you understand and accept the estimated waiting time and workflow.

QUEUE & WORKFLOW

Commissions are not necessarily started or completed in the order in which they are received. The workflow may vary depending on the commission type, complexity, current WIP projects, Priority commissions, and overall workload. Once a commission enters the WIP (Work in Progress) stage, it becomes an active project and is worked on according to the current workflow. Custom Commissions have an overall delivery timeframe of approximately 4-6 months, depending on the commission type, selected add-ons, and provided delivery date. SKEB Commissions have an overall delivery timeframe of approximately 3-4 months, depending on the type of SKEB and provided delivery date. Please note that estimated production time and the overall delivery timeframe are not the same. Production time refers to the period during which the commission is actively being worked on, while the overall delivery timeframe includes time spent in the queue, current workload, project complexity, and additional time reserved for unexpected circumstances.

SOCIAL MEDIA INFORMATION

As the author of all artworks, I reserve the full right to publish any work I have created from the commission - both on social media and in my portfolio. I also reserve the right to stream the entire commission process unless you have specifically requested privacy. Commission privacy is free of charge but must be discussed at the very beginning of our conversation to avoid any misunderstandings. This ensures clarity and respect for both the client’s wishes and my creative process.

COMMISSION POSTING

After the commission has been completed and delivered, you are free to post the artwork on your social media platforms. Tagging or crediting me is not required, as the artwork already includes my Jimiseyo watermark, although it is always greatly appreciated. The artwork and watermark must not be altered, removed, obscured, or replaced, and the artwork may not be claimed as your own creation.

aRTWORK REPOSTING

Others are permitted to repost my commissions and artworks, provided that full credit to my social media or my name is included. Any unconstructive, insulting, rude, or discriminatory comments toward me, my clients, or my artworks will result in being blocked. Modifying, altering, blurring logos, tracing, copying, or using the artworks in AI projects is strictly prohibited. Any violations may result in appropriate legal action.

PERSONAL LICENSE

A Personal License allows you to use the artwork strictly for personal, non-commercial purposes. The artwork may be used on personal social media accounts, Discord profiles, wallpapers, profile pictures, reference galleries, and other non-commercial online spaces. You may also create physical copies for personal enjoyment, such as prints or posters. This license does not permit use on monetized platforms, commercial accounts, merchandise, advertising, promotional materials, or any activity intended to generate revenue. For such uses, a Commercial Content License or Commercial Merchandise License is required.

COMMERCIAL LICENSE

A Commercial Content License allows you to use the artwork as part of digital content created for and distributed through commercial or monetized social media, streaming, and content platforms owned or operated by you, including but not limited to Twitch, YouTube, Kick, Patreon, X (Twitter), TikTok, and similar services. The artwork may be used within your content and online presence, including profile pictures, banners, overlays, thumbnails, promotional graphics, videos, streams, posts, and other digital end products. This license does not permit the resale, redistribution, sublicensing, transfer, or use of the artwork as a standalone product for direct sale or commercial merchandise. This includes, but is not limited to, prints, apparel, physical merchandise, digital downloads, NFTs, stock assets, or other products intended for direct commercial distribution. For such uses, a separate Commercial Merchandise License is required.

LICENSING & RIGHTS

I, Jimiseyo, retain all rights to the artworks I create, as granted by law. By purchasing a commission or service, you are granted only the license tier you have selected (Personal, Commercial Content,  Commercial Merchandise or Branding Usage). Payment for a commission does not transfer any copyright, commercial, or ownership rights. Under no circumstances should the commissioned artwork be considered your property or creation, nor may it be sold, resold, altered, or used for purposes beyond those permitted by this Agreement.

BRAND & MERCH LICENSES

Additional licensing is required when commissioned artwork is intended for merchandise, resale, or use as part of a personal or commercial brand identity. Depending on the intended purpose, a Commercial Merchandise License or Branding Usage License may apply. These licenses grant specific additional usage rights while I, Jimiseyo, retain copyright and ownership of the original artwork unless otherwise agreed in writing. The applicable license defines how the commissioned work may be reproduced, distributed, displayed, or incorporated into commercial products and brand materials.

COMMERCIAL LICENSE

A Commercial Merchandise License allows the creation, promotion, distribution, and sale of physical or digital merchandise featuring the commissioned artwork. This includes, but is not limited to, keychains, stickers, apparel, posters, prints, acrylic products, digital goods, and similar value-added products. This license does not transfer ownership of the artwork itself. The original artwork may not be resold, redistributed, sublicensed, or claimed as your own creation. A Commercial Merchandise License must be requested when submitting a commission. An additional one-time fee equal to 300% of the total commission value will be added to the invoice. The license remains valid for six months and may be extended upon request.

BRANDING USAGE LICENSE

A Branding Usage License allows you to use commissioned branding assets as part of your personal or commercial brand identity. This includes, but is not limited to, Logo Design, Brand Identity, Streaming Graphics, and other visual identity assets. The delivered assets may be used across websites, social media, streaming platforms, printed promotional materials, business documents, product packaging, signage, and in collaboration with third-party designers, developers, printers, or manufacturers when required for their intended purpose. Unlike standard artwork commissions, branding assets are intended to function as part of your visual identity and are therefore not subject to the standard usage limitations of the Personal License or Commercial Content License.  The original branding assets may not be resold or redistributed as standalone digital products, claimed as your own original work, or otherwise exploited independently of the brand they were created for, unless otherwise agreed in writing.

ADDITIONAL STATEMENT

As an artist, I put genuine care and effort into every commission to deliver a polished, high-quality final piece. I approach each client with individual attention and respect, and I expect the same in return. Please remember that you are not only paying for the artwork itself, but also for my time, expertise, and the quality of the final result. I appreciate constructive feedback, as it helps me grow as a digital artist, but personal and professional boundaries must be respected. To keep communication clear and organized, please contact me only through VGen, unless we have agreed on another method in advance.

LEGAL DISCLAIMER

All information contained herein, including this Agreement, is valid and applicable as of September 26, 2026. As our relationship is strictly professional, it is in your best interest to review and understand the terms outlined here. By commissioning my services, you are deemed to have agreed to the provisions of this Agreement. Individual clauses of the Agreement may be updated, and it is the client’s responsibility to remain informed of any changes. Clients will be notified directly in the event of any major or significant updates.

LEGAL & ETHICAL USE

I, Jimiseyo, strictly prohibit the use of any commissioned artwork or related materials I create in connection with hate speech, discrimination, harassment, extremist content, or any form of harmful, illegal, or abusive activity. This includes, but is not limited to: racist, homophobic, transphobic, or otherwise discriminatory messaging; incitement of violence or harassment; defamatory or intentionally harmful representation of individuals or groups; or association with extremist ideologies, movements, or organizations. The use of my artwork for any AI-related purposes is also strictly prohibited. This includes, but is not limited to, AI training or datasets, machine learning, generative AI, image generation, AI-assisted editing or modification, style replication, or uploading the artwork to AI services for processing without my explicit permission. Any violation of this clause will result in the immediate revocation of all granted licenses (Personal, Commercial Content, Commercial Merchandise or Branding Usage), without refund. Upon revocation, the client must immediately cease all use of the artwork across all platforms. I reserve the right to publicly distance myself from any misuse of my work and to take appropriate action to protect my name, brand, and intellectual property.
